Shoplifting Civil Rights Law

Florida law, 812.015, Florida Statutes, limits a retail store’s civil liability for detaining and causing the arrest of a person suspected of shoplifting.  Employees of retail stores, typically loss prevention associates, who have probable cause to believe that a retail theft has been committed by a person and that the stolen property can be recovered by taking the person into custody are permitted to detain the person.  However, the detention must be done in a reasonable manner and for a reasonable length of time.  This law requires that law enforcement be called to store immediately upon the store employees detaining the person.  In the event the store employees follow these requirements, the store may not be held liable in a civil claim for the detention or arrest.  Unfortunately, this law is often not followed carefully enough for a store to be immune from civil liability.
